§1 General Information

The owner of the wallkids.eu online store is the company Tomasz Słomka TOKA+HOME registered in the Central Register and Information on Economic Activity conducted by the minister responsible for economic affairs, NIP 6462439236, REGON 366321114, with its registered office at ul. Jaśkowicka 15 in Tychy - referred to hereinafter as the Seller.

The Buyer through the wallkids.eu online store is referred to hereinafter as the Purchaser.

The provision of customized production services through the walltime.pl online store is carried out based on the provisions specified in these Regulations.

These Regulations define the general rules that constitute the legal basis for using the wallkids.eu online store. Each Purchaser is obliged, from the moment of taking actions aimed at placing an order, to comply with the provisions of these Regulations.

Before placing an order in the wallkids.eu store, please read the following Regulations carefully.

The Seller sells goods via the Internet.

Any correspondence or inquiries regarding the online store wallkids.eu can be sent to the email address: hello@walltime.pl.
§2 Registration

In order to create a User Account, the User is required to complete the Registration process.

Registration is not necessary to place an order in the walltime.pl online store.
-
Registration on the online store, as well as the use of the functionalities of the walltime.pl online store, are free of charge.

Registration is done by filling out and accepting the registration form provided on the wallkids.eu online store's website.
-
During Registration, the User sets an individual Login and Password.
-
Acceptance of the terms of the Regulations, consent to the processing of personal data, and providing data marked as mandatory are conditions for Registration.

By filling out the registration form, the User declares that the provided data is accurate and true.
-
After registering on the wallkids.eu online store, each subsequent login is done using the data provided in the registration form.

To delete a Customer account from the wallkids.eu online store, a request for account deletion must be sent via email to: hello@walltime.pl from the email address provided during registration on the wallkids.eu online store.

The Customer is obligated to protect the account data and not share them with third parties.
§3 Orders

The products presented by the Seller are not an offer for sale, but an invitation for the Buyer to enter into a sales agreement within the meaning of the Civil Code. The Buyer can place an order through the online product configuration and order processing system provided by walltime.pl, available online.

The User can place orders in the wallkids.eu online store through the wallkids.eu website 24 hours a day, 7 days a week.

Only adults are allowed to place orders. Individuals under the age of 18 can make purchases only with the knowledge and consent of their parents/legal guardians.

Placing an order by the Buyer is equivalent to accepting these terms and conditions.
-
Buyers can place orders for products available in the walltime.pl online store either by registering in accordance with the provisions of §2 of these regulations or by providing necessary personal and address data enabling order fulfillment without registration.

The wallkids.eu online store only sells within Poland and Europe.
-
Each ordered product must be configured by the Buyer using the mechanisms available on the walltime.pl website before ordering.

Wallpapers available in the wallkids.eu online store are custom-made according to the individual dimensions provided by the Buyer and are not eligible for return.
-
Placing an Order constitutes an offer made by the Buyer to the Seller to conclude a sales agreement for the goods subject to the Order.
-
After placing an Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for processing. Confirmation of receipt of the Order and its acceptance for processing occurs through the sending of a relevant email message by the Seller to the Buyer's email address provided during the Order placement, containing at least the Seller's statements about the receipt of the Order and its acceptance for processing, as well as confirmation of the conclusion of the Sales Agreement. Upon receipt of the above email message by the Buyer, a Sales Agreement is concluded between the Buyer and the Seller.

Order fulfillment occurs after the full amount of the Order is credited to the Seller's bank account.

In the event of non-payment within a period longer than 7 days from the date of placing the Order, it may be canceled in the wallkids.eu order system.

In the event of the impossibility of performing the service by the Seller, e.g., due to reasons related to the technology of production for an individual Order, the Seller shall immediately, but no later than within 10 days from the conclusion of the Agreement, inform the consumer about this and refund the entire amount received from them.

The Buyer will be informed about the current status of their Order at the email address provided during registration or purchase without registration.
§4 Payment

All prices provided on the walltime.pl online store include: compensation for the use of copyrights utilized during graphic configuration. Shipping costs are separately added.
-
Payments for products should be made in the form of a prepayment to the bank account: ING 46 1050 1399 1000 0092 7031 6707 or through the online payment system imoje.

Order fulfillment takes place after the full amount of the Order is credited to the Seller's bank account.
-
Failure to make a payment within 7 days from the date of Order placement by the Buyer results in the cancellation of the Order by the Seller.
-
In the case of providing incomplete or incorrect data, and in situations where the Order raises doubts, the walltime.pl online store reserves the right to refuse Order fulfillment without specifying a reason. The refunded amount will be returned within 7 days to the account from which the transfer was made.

An invoice is issued for each Order placed on the walltime.pl online store.

From January 1, 2020, to receive an invoice in the future, the Buyer is obligated to provide their Tax Identification Number (NIP) when issuing a receipt.
§5 Delivery

Delivery is carried out in accordance with the prices specified in the online Order for the calculated product and transportation costs. If the Buyer requests a special type of packaging or shipment that incurs higher execution costs, they are obligated to bear the additional costs.

Deliveries within the territory of Poland are carried out through the courier company DPD.
-
The cost of delivery within the territory of Poland is 20 PLN.
-
The fulfillment of an Order in the walltime.pl online store takes up to 14 business days from the moment the payment is credited to the account.
-
The walltime.pl online store is not responsible for any delays in receiving shipments that result from courier company failures to meet deadlines or due to the Buyer providing incorrect delivery information.
-
For larger orders, the walltime.pl online store reserves the right to fulfill them over a longer period of time than specified in the regulations (after prior notification to the Buyer via email or phone).

Packaging for transportation and all other packaging are not subject to return according to packaging guidelines. The Buyer agrees to appropriately dispose of packaging at their own cost.

If the delivery of a product or group of products is not possible, the Seller commits to immediately notify the Buyer of this fact. If the Buyer has already paid for the goods, the full value of their order will be refunded within no more than 10 business days from the Buyer providing their bank account number.

In case of goods delivery not meeting the terms of the Agreement due to the Seller's fault, the Buyer agrees to provide an additional delivery period of no less than 14 days.
§6 Damages Occurred During Transport

When packaging products, the Seller uses a solution where the print does not touch the walls of the packaging. Tubes and cardboard packaging in which products are packed are marked with original stickers featuring the walltime.pl company logo. If the delivered goods to the Buyer have visible damage or lack of company markings, and there is reasonable suspicion that the product has been damaged, this fact should be reported to the freight forwarder/carrier during delivery and a damage protocol should be drawn up in their presence. In justified cases, the acceptance of such a shipment should be refused, and immediate contact should be made through an email sent to: hello@walltime.pl.

In the case of identifying hidden defects, the Buyer should promptly inform the Seller about this fact by sending an email to: hello@walltime.pl.
§7 Warranty

The Seller shall not be held responsible for minor discrepancies in the delivered goods compared to the offered goods. In the case of prints of wallpapers, posters, and stickers, slight deviations in colors compared to the colors seen on the screen and the colors of ordered samples, as well as deviations arising from differences in material surfaces, are technically and production-wise unavoidable. Such deviations do not entitle the Buyer to file a complaint.

To gain a better understanding of Walltime brand products, the Buyer can order a wallpaper print sample for 30 PLN (including shipping). The sample size is 30x40cm.

The materials used by the Seller for producing the offered products are generally available in this industry. In the case of prints, inks, materials, light resistance, etc., the responsibility is limited to the average durability of the given products. Prints are not waterproof without additional finishing.

The Buyer is obliged to inspect the goods immediately upon receipt. In the event of errors in order fulfillment, such as incorrect dimensions, improper matching of panels, color variations between panels, missing panel sets, absence of laminate (if ordered), the Buyer should promptly report them in writing to the Seller's email address. The store guarantees replacement of the goods with the correct ones, provided that manufacturing errors are reported within 10 days from the date of receiving the shipment. After this period, the goods are considered accepted.

The Buyer reporting a defect is required, upon request by the Seller, to send the defective item for the purpose of the complaint process. The Seller is obligated to conclude the complaint process as quickly as possible, but no later than 14 days from the date of receiving the item. The end of the process signifies the determination of the stance and is counted from the moment of delivering the goods. In case the Seller fails to meet this deadline, the Buyer is entitled to terminate the Agreement and request a refund of the paid Order amount.

In the case of errors in order fulfillment (dimensions, number of panels, panel matching, laminate, graphic quality), complaints should always be submitted before wall installation - by taking photos and sending them to the email address hello@walltime.pl.

If the installation of wallpaper, sticker, poster, or self-mounted picture has been started or completed (which means the product cannot be returned in an undamaged state), the opportunity to complain about defects that should have been detected before installation work does not apply.

Products subject to complaints should be returned in a regular package along with the sales document (receipt, invoice) and a note specifying the reason for the complaint. After a successful complaint review, the costs of returning the package will be reimbursed.

Any shipments sent at the expense of the walltime.pl online store will not be accepted.
-
Damages resulting from incorrect or non-compliant actions by the Buyer during the installation or use of the product, which do not conform to the Agreement, are not a basis for claims against the Seller. Incorrect or non-compliant actions are defined in the information provided by the product manufacturer.
§8 Return of Goods

The walltime.pl online store offers only customized products.

The Buyer specifies the parameters of the Order - selects the design or its segment, material, print dimensions, and optionally finishing options.

The product ordered by the Buyer (wallpaper, poster, sticker) is configured based on an individual and detailed Order. Therefore, in accordance with the content of Article 38 point 3 of the Act of May 30, 2014, on consumer rights, the Right of Withdrawal from a distance or off-premises contract does not apply to a consumer in relation to a contract where the subject of the performance is an item that is not prefabricated and is manufactured according to the consumer's specifications (individual order) or is intended to satisfy their individualized needs.
§9 Copyright

All products (hereinafter referred to as works) sold by Walltime company are protected by copyright law. The Buyer or third parties are not authorized to produce, distribute, or replicate the products offered by the Seller.

Any use of the work and deriving income from it is only possible after purchasing a license for the specific work and obtaining written consent from the Seller. In case of failure to pay the licensing fee and obtain consent from the Seller, individuals or entities utilizing Walltime company's products will be required to immediately cease using the works, remove them at their own expense, and pay appropriate compensation. In disputed cases, the matter will be referred to the competent court.

Works made available on the walltime.pl online store (such as photos, texts, and others) may only be published on the internet with the Seller's consent, along with the mention of the name and address of Walltime company's online store - www.walltime.pl.

Matters not regulated in this paragraph are subject to the provisions of the Act of February 4, 1994, "On Copyright and Related Rights" (Journal of Laws of 2006, No. 90, item 631, as amended).
§10 Final Provisions

Resolving any disputes arising between the Seller and the Buyer, who is a consumer within the meaning of Article 22 § 1 of the Civil Code, shall be subject to the jurisdiction of the courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

Matters not regulated in this Regulation shall be governed by the provisions of the Civil Code, the provisions of the Act on the Provision of Electronic Services, and other relevant provisions of Polish law.
