Regulations

Use of the walltime.co.uk webshop implies acceptance of these terms and conditions.

 

§1 General information

 

  1. The owner of the walltime.pl internet shop is the TOKA+HOME Tomasz Słomka company, registered in the Central Register of Business Activity and Information kept by the minister responsible for economy, NIP 6462439236 with the seat at ul. Jaśkowicka 15 in Tychy - hereinafter referred to as the Seller.

  2. The Buyer through the walltime.pl Internet shop - hereinafter referred to as the Purchaser.

  3. Providing custom-made products through the walltime.pl Internet shop is done according to the rules stipulated in these Terms and Conditions.

  4. These Terms and Conditions set out the general rules constituting the legal basis for the use of walltime.pl shop. Each buyer is obliged to comply with these Terms and Conditions as soon as they start placing an order.

  5. Please read these Terms and Conditions carefully before placing your order at walltime.pl.

  6. The following provisions of these Terms and Conditions supersede any verbal or written previously agreed upon terms and conditions of delivery, payment, guarantee and liability of the seller, unless a separate agreement has been concluded with the buyer covering the service provided by walltime.pl.

  7. The buyer undertakes to provide complete and truthful (name, place of residence etc.) data in the order form. In the event that false data are provided, the buyer will be held liable for any resulting damage.

  8. In the event of any ambiguity or queries, the walltime.co.uk webshop can be contacted by e-mail at: hello@walltime.pl

  9. No registration is required to view the range of products offered by the walltime.co.uk webshop.

 

§2 Registration

 

  1. In order to create a user account, the user is obliged to register.

  2. Registration is not necessary to place an order in the walltime.pl online shop.

  3. Registration in the internet shop as well as using the functionalities of the walltime.pl internet shop are free of charge.

  4. Registration takes place by completing and accepting the registration form, which is made available on the website of the walltime.pl Internet shop.

  5. During the registration the user sets up an individual Login and Password.

  6. The condition of the Registration is the acceptance of the terms and conditions of the Terms and Conditions, consent to the processing of personal data and provision of personal data marked as obligatory.

  7. By completing the registration form, the user declares that the data provided are factually correct.

  8. After registration in the walltime.pl online shop, each time the user logs in, the data provided in the registration form are used.

  9. In order to delete the customer's account from the walltime.pl online shop, a message requesting the deletion of the account should be sent by e-mail to:hello@walltime.plfrom the e-mail address provided during registration in the walltime.pl online shop.

  10. The customer is obliged to protect the customer's account data and not to make it available to third parties.

 

§3 Orders

 

  1. Products presented by the Seller are not an offer for sale, but only an invitation to the Purchaser to enter into a sales agreement within the meaning of the Civil Code. The Purchaser may place an order through walltime.pl's online product configuration and order handling system.

  2. The user can place orders in the online shop via the walltime.pl website 7 days a week, 24 hours a day.

  3. Orders may only be placed by persons of full age. Persons under the age of 18 may only make purchases with the knowledge and consent of their parents/legal guardian.

  4. Placing an order by the Purchaser is tantamount to acceptance of these rules.

  5. Placing orders by the Purchaser for products in the walltime.pl online shop assortment is possible after the registration, in accordance with the provisions of § 2 of the Terms and Conditions, or by providing necessary personal and address data, which enables the execution of the order without registration.

  6. The walltime.pl online shop sells only in Poland and Europe. Foreign orders are processed after prior agreement via e-mail on the method and cost of shipment.

  7. Each ordered product has to be pre-configured by the buyer using the mechanisms available on the walltime.pl website. The buyer takes full responsibility for the correctness of the given measurements. The seller is not liable for incorrect dimensions resulting from incorrect measurements made by the buyer. It is recommended to add the appropriate fitting stock according to the instructions provided by the seller.

  8. Wallpapers available in the walltime.pl online shop are produced to individual measurements given by the Purchaser each time and are not subject to return.

  9. Placing an Order shall constitute an offer by the Purchaser to the Seller to conclude a Sales Agreement for the goods subject to the Order.

  10. After placing the Order, the Seller shall immediately confirm its receipt and at the same time accept the Order for fulfilment. Confirmation of receipt of the Order and its acceptance for execution shall be effected by the Seller sending to the Purchaser the relevant e-mail message to the Purchaser's e-mail address provided at the time of submitting the Order, which shall contain at least the Seller's statements of receipt of the Order and its acceptance for execution as well as confirmation of concluding the Sales Agreement. Upon receipt by the Purchaser of the aforementioned e-mail message, the Sales Agreement between the Purchaser and the Seller is concluded.

  11. The Order shall be executed after the full amount of the Order is credited to the Seller's bank account.

  12. In case the payment is not settled within more than 7 days from placing the Order, it may be cancelled in the walltime.pl order system.

  13. In the event of the Seller's inability to perform, e.g. for reasons depending on the production technology for an individual Order, the Seller shall notify the consumer immediately, but not later than within 10 days from the conclusion of the Agreement, and return the entire amount of money received from the consumer.

  14. The Purchaser shall be informed of the current status of his Order to the e-mail address provided during registration or purchase without registration.

  15. Pattern framing - Any wallpaper pattern can be adjusted free of charge by our framing team to best suit your needs and order specifications.

  16. Other pattern modifications - Any additional modifications to the pattern, such as changing the colour scheme, adding or removing graphic elements, changing the proportions of the pattern or other individual modifications, are priced on an individual basis. The cost of such modifications will be determined by the complexity of the order and the amount of work involved.

 

§4 Payment

 

  1. All prices quoted in the walltime.co.uk webshop include: remuneration for the use of copyright used in the configuration of the graphics. Shipping costs are added separately.

  2. Payments for products should be made by prepayment to the bank account:

    ING 79 1050 1399 1000 0092 3662 9177 or through the online payment system payment24.pl.

  3. The execution of the Order takes place after the full amount of the Order is credited to the Seller's bank account.

  4. Lack of payment within 7 days from the date of placing the Order by the Purchaser results in cancellation of the Order by the Seller.

  5. In case of providing incomplete or incorrect data and in the situation when the Order raises any doubts, walltime.pl Internet Shop reserves the right to refuse the execution of the Order without giving any reason. The amount paid shall be refunded within 7 days to the account from which the transfer was made.

  6. An invoice is issued for each Order placed at the walltime.pl online shop.

  7. From 1 January 2020, if the Purchaser wishes to receive an invoice in the future, he/she is obliged to state the VAT number when issuing the receipt.

 

§5 Delivery

 

  1. Delivery shall take place in accordance with the prices of the calculated product and transport costs stated in the Online Order. If the Purchaser wishes a special type of packaging or shipment which involves higher delivery costs, the Purchaser shall bear the additional costs.

  2. Deliveries on the territory of Poland are carried out by the courier company DPD.

  3. The cost of delivery on Polish territory is 25 PLN.

  4. The execution of the order in the walltime.pl online shop takes up to 21 working days from the moment the payment is credited to the account.

  5. walltime.pl online shop is not responsible for any delays in receiving the parcel due to the courier company's failure to meet the deadlines or due to the buyer providing incorrect data for delivery.

  6. In the case of larger orders, walltime.co.uk reserves the right to deliver them within a longer period of time than stated in the terms and conditions (after informing the buyer by e-mail or telephone).

  7. Packaging for transport and any other packaging is non-returnable, according to the packaging guidelines. The Purchaser undertakes to dispose of packaging appropriately at his own expense.

  8. In the event that delivery of a product or group of products is not possible, the seller undertakes to notify the Purchaser immediately. If the Purchaser has already paid for the goods, the full value of his order will be refunded within a maximum of 10 working days after the Purchaser has indicated his bank account number.

  9. In the case of delivery of the goods that does not correspond to the contractual arrangements through the fault of the seller, the buyer undertakes to grant an additional lead time of no less than 14 days.

 

§6 Damages caused during transport

 

  1. When packaging the products, the Seller shall use a solution in which the print does not come into contact with the walls of the packaging. The tubes and cardboard packaging in which the products are packed are marked with original stickers with the walltime.co.uk trademark. If the delivered goods have visible damage or the company markings are missing and there is a justified suspicion that the product has been damaged, this fact should be reported to the forwarding agent/carrier during delivery and a damage report should be drawn up in his presence. In justified cases, such a consignment must be refused and contacted immediately by e-mail sent to: hello@walltime.pl.

  2. In the case of hidden defects, the Purchaser should immediately inform the Seller about this fact in the form of an e-mail sent to the address: hello@walltime.pl.

 

§7 Warranty

 

  1. The Seller shall not be liable for minor deviations of the delivered goods from the offered goods. In the case of photo wallpaper prints, posters and stickers, slight deviations in colour compared to the colour seen on the screen and thethe colour of the ordered samples as well as deviations resulting from surface differences of the materials are technically and industrially unavoidable. Such deviations do not entitle to claim.

  2. In order to get a better idea of the Walltime products on offer, the buyer may order a sample print of a wall mural for the price of PLN 35 (incl. postage). The size of the sample wallpaper is 100 x 30 cm.

  3. Materials generally available in the industry are used in the manufacture of the products offered by the Seller. In the case of prints, inks, materials, lightfastness, etc., liability shall only apply to the average durability of the products in question. Prints are not waterproof without additional finishing.

  4. The purchaser is obliged to check the goods immediately upon receipt. If errors are found in the order, i.e. In the case of mistakes in the order implementation, i.e. wrong dimensions, wrong size, colour differences between particular blocks, lack of a set of blocks, lack of laminate (if ordered), the Purchaser should immediately report them in writing to the Seller's e-mail address. The shop guarantees the exchange of the goods for the correct one provided that production errors are reported within 10 days of the receipt of the parcel, after this time the goods are considered accepted.

  5. Due to the nature of the manufacturing process, a dimensional tolerance of ± 1% from the ordered dimension is allowed for the product. The indicated tolerance does not constitute a product defect and cannot be the basis for a complaint.

  6. The Purchaser reporting the defect is obliged to send the defective product at the Seller's request in order to carry out the complaint process. The Seller is obliged to complete the complaint process as soon as possible within a maximum period of 14 days. Completion of the process means the determination of the position and is counted from the delivery of the goods. In the event of the Seller's failure to meet the stated deadline, it entitles the Purchaser to terminate the Contract and demand a refund of the Order amount paid.

  7. In the case of errors in the fulfilment of the order (dimensions, number of units, fit of units, laminate, quality of the graphics), complaints should always be submitted prior to mounting on the wall - by taking photos and sending them to the e-mail address at hello@walltime.pl.

  8. If the installation of the wall mural, sticker, poster or picture is started or executed (which means that the product cannot be sent back to us intact), the possibility to complain about defects that should have been detected before the installation work was carried out is not applicable.

  9. The Seller shall not be liable for defects caused by installation of the product on an inadequately prepared surface, in particular on damp, dirty, uneven or unstable walls. The purchaser is obliged to prepare the surface in accordance with the installation instructions.

  10. The products which are the subject of the complaint should be sent back by an ordinary parcel together with a sales document (receipt, invoice) and a note concerning the reason for the complaint. If the complaint is accepted, the cost of sending the parcel back will be refunded.

  11. Any parcels sent at the expense of the walltime.co.uk online shop will not be accepted.

  12. Damages caused by incorrect or incompatible actions of the Purchaser during the installation or use of the goods do not constitute grounds for claims against the Seller. Incorrect or incompatible actions are specified in the information given by the manufacturer of the goods.

 

§8 Return of Goods/Claims

 

  1. The walltime.co.uk online shop offers only custom-made products.

  2. The Purchaser specifies the parameters of the Order - selects the graphic design or its fragment, material, print size and possibly finishing options.

  3. The product ordered by the Purchaser (wall mural, poster, sticker) is configured on the basis of an individual and detailed Order, therefore, in accordance with the content of art. 38 item 3 of the Act of 30 May 2014. on consumer rights, a consumer is not entitled to withdraw from a contract concluded off-premises or at a distance in relation to a contract in which the subject of the performance is a non-refabricated item, produced according to the consumer's specifications (individual order) or serving to satisfy his/her individualised needs.

  4. Complaints will not be accepted in the event of differences in shade or colour tones between the product and its presentation on the screen of a computer, telephone or other device. These differences may be due to the display settings and its colour reproduction technology.

  5. To avoid colour confusion, we recommend that you take the opportunity to order a sample before placing the actual order.

  6. If a wallpaper sample is ordered before the actual wallpaper is purchased, the customer is obliged to compare the final print with the sample received and to check for colour, pattern and workmanship consistency before starting the installation. Any discrepancies must be reported before installation. The installation of the product is tantamount to accepting its conformity with the order and the sample.

  7. Once the wallpaper has been pasted on the target surface, the product is considered accepted in terms of its conformity to the order, the quality of the print and any defects visible prior to installation. Wallpaper that has been fully or partially pasted is not subject to any return or claim for defects that could be detected before application. The customer is obliged to check the product before installation.

  8. Due to the production process, minor colour differences between the sample and the final product are permissible. These differences may result in particular from the lapse of time between the making of the sample and the realisation of the order, the use of new batches of printing materials, calibration of printing machines and natural wear and tear of consumables used in the production process. These differences do not constitute a product defect and cannot be the basis for a complaint.

  9. In the case of ordering additional blocks or re-ordering the same design at a later date, the Seller does not guarantee that the colours will be identical to those previously ordered. Differences may be due to material batch changes, production parameters or calibration of printing equipment and do not constitute grounds for a complaint.

 

§9 Copyright

 

  1. All Walltime products sold (hereinafter referred to as works) are protected by copyright. The purchaser or third parties are not authorised to produce, distribute or reproduce the products offered by the seller.

  2. Any use of and income from the work shall only be possible after the purchase of a licence for the work and the written consent of the seller. In the absence of the licence fee and the Seller's consent, the user of Walltime's products will be called upon to immediately cease using the works and remove them, at his/her own cost and expense, and to pay appropriate compensation - in cases of dispute, the case will be sent to the competent court.

  3. The works made available on the walltime.co.uk webshop (photos, texts and other) may be published on the Internet only with the consent of the Seller, together with the name of Walltime's webshop - www.walltime.pl.

  4. Any matters not regulated in this paragraph shall be governed by the provisions of the Act of 4 February 1994 "On Copyright and Related Rights" (Journal of Laws of 2006, No. 90, item 631 as amended).

 

§10 Final provisions

 

  1. Any disputes arising between the Seller and the Purchaser, who is a consumer within the meaning of Article 22 § 1 of the Civil Code, shall be referred to the competent courts in accordance with the provisions of the relevant provisions of the Civil Procedure Code.

  2. In matters not regulated herein, the provisions of the Civil Code, the provisions of the Act on Rendering Electronic Services and other relevant provisions of Polish law shall apply.
